The Consumer Financial Protection Bureau has decided to begin the rulemaking process for regulating arbitration, releasing an outline of its proposal at a field hearing in Denver, Colo. The proposal seeks to eliminate class-action waivers in arbitration clauses as well as require companies to submit arbitration disputes and resolutions to the bureau for further monitoring. The Federal Housing Finance Agency proposed a rule that would revise the requirements for financial institutions to apply for and retain membership in one of the 12 Federal Home Loan Banks. The proposed rule would revise FHFA’s existing bank membership regulation to ensure that members maintain a commitment to housing finance and that only eligible entities can gain access to bank advances and the benefits of membership, the agency said.

The Federal Housing Finance Agency proposed a rule that would update housing goals for government-sponsored enterprises Fannie Mae and Freddie Mac for 2015 through 2017. The Housing and Economic Recovery Act of 2008 requires FHFA to establish annual housing goals for both GSEs, and FHFA’s current housing goals rule is effective through the end of this year.

Federal banking and credit union regulators are repealing rules that define acts or practices that are unfair or deceptive. The repeal is a consequence of Dodd-Frank, and regulators issued guidance clarifying that they still have supervisory and enforcement authority regarding unfair or deceptive acts or practices, notwithstanding the repeal of the regulations.
