The Consumer Financial Protection Bureau released a guidance bulletin regarding in-person debt collection practices, warning against the risks for violations of the Dodd-Frank Act (the Consumer Financial Protection Act) and the Fair Debt Collection Practices Act.

For 2016, the Federal Deposit Insurance Corp., Office of the Comptroller of the Currency and the Federal Reserve Board will be paying “special attention” to commercial real estate lending. When conducting examinations, the agencies stated that they will focus on financial institutions’ implementation of the prudent principles found within “Concentrations in Commercial Real Estate Lending, Sound Risk Management Practices.”

The Consumer Financial Protection Bureau (CFPB) has released a guidance document regarding marketing services agreements (MSAs). Without directly calling them illegal, the guidance does highlight the high level of compliance risks and reiterates the CFPB’s findings that they have been used to disguise referral schemes and kickbacks that violate RESPA.

The Consumer Financial Protection Bureau has issued a guidance document regarding the treatment of mortgage applicants who receive public assistance from the Section 8 Housing Choice Voucher Homeownership Program. The bureau wanted to remind creditors that it is a violation of the Equal Credit Opportunity Act to deny access to credit on the basis of applicants’ receiving income from public assistance programs.
